In DE OBALDIA & GARCIA DE PAREDES, on the procedural subject, we usually represent our clients in administrative, mercantile and civil proceedings.

In administrative proceedings we cover governmental resources before the different state entities on tax or related subject with bid administrative applications, bidding, concessions, contracts with the State, etc.

At the administrative level, after having exhausted governmental method, we resort to the Third Court of the Supreme Court of Justice, in order to promote nullity remedy or full jurisdiction.

In the Mercantile Area, our office handles nullity and reposition of securities, lawsuits in connection with the administration of mercantile companies, claims among entrepreneurs due to default of mercantile obligations, banking and financial transactions, collection process of maritime origin and claims in connection with insurance contracts.

In the civil area we handle ordinary and executive proceedings. The executive proceedings are related with the compliance request of an obligation previously acknowledged and the ordinary proceedings purporting to verify the existence of the obligation and request compliance of same or the payment of an indemnification for default whenever it proceeds. The majority of the proceedings that our office handles are related to the collection of commercial accounts for providing goods and services.

When we act on behalf of our plaintiffs we carry out prior investigations to evaluate the benefits of practicing precautionary measures to safeguard properties that may allow the collection of the obligations once judicial transactions are concluded.

Our office handles processes of consumer protection, opposition or cancellation of mark registrations processes, processes related to the protection of Industrial and Intellectual Property rights and Processes for disloyal competition.
